Privacy Policy

The short answer

ArkPerform Advisory collects only the personal data you give us through our forms, WhatsApp and email, plus basic website analytics. We use it to reply to you, deliver our services and improve this website. We never sell it. We handle it under Malaysia’s Personal Data Protection Act 2010, and you can ask to see, correct or delete it at any time by emailing hello@arkperform.co.

How we handle your personal data

1. Who we are

This website, arkperform.co, is run by ArkPerform Advisory (202503246734 (SA0642357-K)), a business registered in Malaysia (“ArkPerform”, “we”, “us”). We are the data user responsible for your personal data under the Personal Data Protection Act 2010, as amended by the Personal Data Protection (Amendment) Act 2024 (“PDPA”). This policy explains what we collect, why, who sees it and what you can ask us to do with it. It applies to this website, to enquiries you send us and to the services we provide.

2. Personal data we collect

Contact details: your name, company, job title, email address and phone or WhatsApp number.
Enquiry details: what you tell us about your business, your goals, your budget range and your timeline.
Engagement records: proposals, agreements, invoices, payment records and the messages, calls and meetings we have with you.
Account access: logins or user access you grant us to tools such as Google Ads, Meta Business Manager, Google Analytics, Google Search Console, your website or your CRM.
Technical data: your IP address, device, browser, the pages you visit, how you arrived at this website and similar information collected through cookies and analytics tools.

3. How we collect it

We collect personal data when you fill in a form on this website, message us on WhatsApp, email or call us, meet us, sign a proposal or grant us access to your accounts. We also collect technical data automatically when you browse this website, and we may use publicly available business information, such as a company website or a LinkedIn profile, to prepare for a conversation with you.

4. Why we use it

To reply to your enquiry and arrange a call.
To prepare proposals and quotations.
To deliver, manage and report on the services you engage us for.
To invoice you, collect payment and keep proper accounting and tax records.
To send you service updates and, where you agree, our guides and news. You can opt out of marketing at any time.
To understand how this website is used, measure our own advertising and improve both.
To meet our legal and regulatory obligations and to protect our rights.

5. Is giving us your data compulsory?

The fields marked as required on our forms are needed for us to reply to you. Everything else is optional. If you choose not to give us the data we need, we may not be able to respond to your enquiry or deliver our services.

6. Your customers’ data

When we work inside your advertising, analytics or CRM accounts, we may see personal data about your own customers. We handle that data only on your instructions and only for your project, we keep it confidential and we do not use it for anything else. You remain responsible for giving your customers proper notice and for having the right to share their data with us.

7. Cookies and tracking

This website uses cookies and similar tools, such as Google Analytics, Google Ads and Meta, to measure visits and the performance of our own advertising. These tools may set cookies on your device and may process data on servers outside Malaysia. You can block or delete cookies in your browser settings and manage advertising preferences in your Google and Meta account settings. Blocking cookies will not stop you from using this website.

8. Who we share it with

Service providers who help us run the business, such as website hosting, email, cloud storage, form, messaging and accounting providers.
Advertising and analytics platforms, such as Google, Meta and X, when we run campaigns for you or for ourselves.
Our professional advisers, such as accountants, auditors and lawyers.
Government agencies, regulators, courts or law enforcement, where the law requires it.
A buyer or successor, if our business is restructured or transferred, under the same protections as this policy.

We do not sell your personal data.

9. Transfers outside Malaysia

Some of our service providers store data on servers outside Malaysia. When your personal data is transferred outside Malaysia, we take reasonable steps to make sure it receives a level of protection comparable to the PDPA, as the law requires.

10. How we protect it

We limit access to the people who need it, use two-factor authentication on our business accounts, give the least access needed for each task and remove access when a project ends. If a personal data breach occurs that is likely to cause significant harm, we will notify the Personal Data Protection Commissioner and the people affected, as the PDPA requires.

11. How long we keep it

We keep personal data only for as long as we need it for the purposes above. Enquiries that do not lead to an engagement are kept for up to 24 months. Client records, invoices and payment records are kept for seven years to meet Malaysian tax and accounting requirements. After that, we delete the data or make it anonymous.

12. Your rights

Ask for a copy of the personal data we hold about you.
Ask us to correct data that is inaccurate, incomplete or out of date.
Withdraw your consent, or ask us to stop using your data for direct marketing.
Ask us to transmit your data to another data user, where this is technically feasible.
Make a complaint to the Personal Data Protection Commissioner of Malaysia.

To make a request, email hello@arkperform.co. We will reply within 21 days. We may ask you to confirm your identity, and an access request may carry the fee allowed under the PDPA regulations.

13. Children

Our services are for businesses. This website is not directed at anyone under the age of 18, and we do not knowingly collect personal data from children.

14. Language

This policy is available in Bahasa Malaysia on request. If the English and Bahasa Malaysia versions differ, the English version applies.

15. Changes to this policy

We may update this policy from time to time. The latest version is always on this page, with the date it was last updated at the top.
